Not every termination needs to be a fight, and there are very few situations that don't benefit from a diplomatic solution. The N11 form from the Ontario Landlord and Tenant Board (LTB) is nearly always the preferred choice for a termination no matter the situation. This form is effectively a blank slate where Landlord and Tenant can agree to end a tenancy, and what day that will happen. The option to negotiate a more "wholistic" resolution between the parties, and the flexibility that provides, cannot be understated.
The question I get most is "What will happen if they/I sign an N11 and don't move out?" The LTB form L3, has the answer. Be aware, the L3 must be filed within 30 days of the agreed termination date. Also, know that any verbal agreements you make to vary the N11 could void the N11 entirely. Landlords will also need to include a copy of the signed N11 and an affidavit confirming the contents of the notice on filing. Once this is done, the board will schedule a hearing for eviction.
